So if there is no more wine (Smokey smashed the bottle) then Jacob cannot do that toast (that their imposter mom did) and name his successor; therefore, Jacob cannot make anyone a new guardian?

i don't think it was the wine that mattered but the prayer that preceeded it.

The wine did not matter. If you watch Ab Aeterno closely, I believe Richard never drank the wine offered to him by Jacob. But, he did promise MIB on the BR, that he would do anything asked of him. Interesting, huh? :p
